The Shift App - Privacy Policy

This Privacy Policy explains how Kingsford Co., the company behind Eliza Kingsford's programs, collects, uses, and shares information when you use The Shift by Eliza Kingsford mobile app (the "App"). By using the App, you agree to this policy. If you do not agree, please do not use the App.

The App is a free companion to Eliza Kingsford's programs. It is built and hosted on Kajabi, a third-party platform, so some of your information is processed by Kajabi on our behalf as described below.

Information we collect

We collect three kinds of information: what you give us, what you post, and what your device sends automatically.

We do not ask you to enter weight, food, medical, or other health measurements in the App, and we do not require payment information in the App, which is free.

How we use information

We use your information to run the App and the community, and we do not sell it.

Create and manage your account and let you sign in
Deliver program content and show your posts and messages to the people meant to see them
Send push notifications and emails about new content, replies, and account matters (you can turn these off)
Moderate the community and enforce our [Terms of Service]
Answer your questions and provide support
Understand how the App is used so we can fix bugs and improve it
Tell you about Eliza Kingsford's programs, events, and resources, where you have agreed to receive marketing
Comply with the law and protect the rights and safety of our members, our team, and others

How information is shared

We share information only in the limited ways below, and we do not sell or rent your personal information.

Kajabi. Kajabi hosts the App and processes account, community, and usage data on our behalf. Kajabi's handling of data is also covered by the Kajabi Privacy Policy.
Other service providers. Companies that help us operate, such as email delivery, push notifications, analytics, and customer support tools. They may use your information only to provide services to us.
Apple and Google. When you download the App, Apple or Google processes information under their own privacy policies.
Other members. Your name, profile photo, and community posts are visible to other members of the community or group you post in. Private messages are visible to the people you send them to.
Eliza Kingsford and her team. Our staff can see community activity and messages sent to them in order to support members and moderate the community.
Legal and safety. When required by law, legal process, or to protect the rights, property, or safety of members, our team, or the public.
Business transfers. If our business is sold or merged, information may transfer to the new owner, who must honor this policy.

Community content

Anything you post in the community can be seen by other members, so please share only what you are comfortable making visible to them.

The community talks about weight, food, stress, and emotional health. If you choose to share personal health details, struggles, or medications in a post, other members will see them, and we cannot control what they do with that information. We ask members to keep what others share in confidence, but we cannot guarantee it.

The App and its community are for education and peer support. They are not therapy, medical care, or a substitute for professional treatment, and posting in the App does not create a therapist–client or provider–patient relationship.

Retention, security, and deleting your account

You can delete your account at any time from inside the App, and we keep your information only as long as we need it.

Deleting your account. Go to [Settings › Account › Delete account] in the App, or email [email protected]. We will delete or de-identify your account information within [30] days, except where the law requires us to keep it.
Retention. We keep account information while your account is active. Community posts may remain visible after you delete them in limited cases, such as quoted replies or copies other members made. Backups are overwritten on a rolling basis.
Security. We and Kajabi use reasonable administrative, technical, and physical safeguards, including encrypted connections. No system is perfectly secure, so please use a strong, unique password.

Your choices and rights

You control your notifications, your marketing preferences, and access to your data.

Notifications. Turn push notifications off in your phone's settings. Unsubscribe from marketing emails with the link in any email; we will still send essential account messages.
Your data. Update your profile in the App at any time. To request a copy of your information, a correction, or deletion, email [email protected]. We will verify your identity before acting and respond within 45 days.
State privacy rights. Depending on where you live, such as California, Colorado, Virginia, or other US states with privacy laws, you may have added rights to know, access, correct, delete, or opt out of certain uses of your information. We will honor these requests as the law requires and will not discriminate against you for using them.
Do Not Track. The App does not respond to browser Do Not Track signals.

Children

The App is for adults 18 and older. We do not knowingly collect information from anyone under 18; if we learn we have, we will delete it. Contact us if you believe a minor has created an account.

Changes to this policy

We may update this policy from time to time. We will post the new version in the App and on our website with a new effective date, and notify you in the App or by email if the changes are significant.

The Shift App Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Kingsford, Co ("we," "us," or "our") for your use of The Shift by Eliza Kingsford mobile app (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Eligibility and accounts

You must be at least 18 years old to use the App.

Give accurate information when you sign up and keep it current.
Keep your password private. You are responsible for activity on your account.
One person per account; do not share or transfer your account.
Tell us right away at [email protected] if you think someone else has used your account.

The App is currently free. If we add paid features, we will tell you the price and terms before you are charged.

Not medical or therapy advice

The App provides education and peer support only. It is not medical care, mental health treatment, or therapy.

Eliza Kingsford is a licensed psychotherapist, but using the App does not create a therapist–client, provider–patient, or other professional relationship with her or anyone on our team.
Content in the App is general information. It is not tailored to your health, and it does not replace advice from your doctor, therapist, or dietitian.
Talk with your doctor before changing your eating, exercise, or any medication, including GLP-1 medications. Never stop or change a prescribed medication based on the App.
Information shared by other members reflects their own experience and is not professional advice.

In an emergency, call 911. If you are in crisis or thinking about harming yourself, call 911. The App is not monitored in real time and cannot respond to emergencies.

Community guidelines

The community works because members feel safe being honest, so treat everyone with kindness and respect their privacy.

You agree not to:

Harass, shame, bully, or threaten anyone, including body-shaming or comments on other members' weight or eating
Share another member's posts, stories, or identity outside the App without their permission
Promote extreme dieting, purging, or other harmful behaviors, or give medical or medication advice
Sell, advertise, recruit, or promote products, programs, or multi-level marketing
Post anything illegal, hateful, sexually explicit, or that infringes someone else's rights
Impersonate anyone, create fake accounts, or misrepresent your connection to us
Hack, scrape, overload, or interfere with the App or other members' use of it

Moderation. We may review, remove, or restrict content and suspend or remove members who break these guidelines, at our discretion and without notice. Report a concern to [email protected] or with the App's reporting tools.

Content and ownership

You own what you post; we own the App and Eliza Kingsford's program materials.

Your content. You keep ownership of the posts, comments, and messages you submit. You give us a non-exclusive, royalty-free, worldwide license to host, store, display, and share your content within the App as needed to run the community. We will not use your posts publicly, such as in marketing or testimonials, without your separate permission. You are responsible for what you post and confirm you have the right to share it.

Our content. The App, including Eliza Kingsford's videos, lessons, worksheets, audio, the names The Shift and Brain-Powered Weight Loss, and the EK logo, is owned by us or our licensors and protected by copyright and trademark law. We give you a personal, non-transferable, revocable license to use it for your own non-commercial use. Do not copy, record, resell, share, or redistribute it.

Third-party services and app stores

The App runs on Kajabi and is distributed through Apple and Google, whose own terms also apply.

Kajabi. Kajabi hosts the App. Your use is also subject to Kajabi's terms where they apply to end users. We are not responsible for outages or changes on Kajabi's side.
Links. The App may link to other websites or services. We do not control them and are not responsible for their content or practices.
Apple. If you downloaded the App from the Apple App Store: these Terms are between you and us, not Apple. Apple has no obligation to provide maintenance or support, is not responsible for any product or intellectual-property claims about the App, and is a third-party beneficiary of these Terms with the right to enforce them against you. You confirm you are not in a US-embargoed country or on a US government restricted-party list.
Google. If you downloaded the App from Google Play, the Google Play Terms of Service also apply.

Ending your use

You can stop using the App and delete your account at any time from the App's settings. We may suspend or end your access if you break these Terms, if required by law, or if we discontinue the App. Sections that by their nature should survive, such as content ownership, disclaimers, and limits of liability, continue after your account ends.

Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT PROMISE ANY PARTICULAR WEIGHT, HEALTH, OR OTHER RESULT, OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP IS LIMITED TO $100. Some states do not allow these limits, so they may not apply to you.

Indemnity

You agree to defend and hold us harmless from claims arising from your content, your breach of these Terms, or your misuse of the App.

Disputes and governing law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Before filing any claim, please contact us at [email protected] so we can try to resolve it informally within 30 days. Any dispute that is not resolved will be handled in the state or federal courts located in Denver, Colorado, and you and we consent to their jurisdiction.

Changes to these Terms

We may update these Terms from time to time. We will post the new version in the App with a new effective date and notify you of significant changes. Continuing to use the App after changes take effect means you accept them.

General

If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. You may not assign these Terms; we may assign them in connection with a sale or reorganization of our business. These Terms and our Privacy Policy are the entire agreement about the App.
